1. General Provisions
Ann Brosens is the owner and Paul Van de Putte is the operator of BECAUSE THE NIGHT ANTWERP LODGE.
The owner and operator may be replaced by a third party, who will be in charge of day-to-day management.
These General Terms and Conditions apply to all guests of BECAUSE THE NIGHT ANTWERP LODGE. , located at Verschansingstraat 53 in 2OOO Antwerp.
With the conclusion of a rental agreement/reservation, these General Terms and Conditions come into force.
Upon simple request, a copy of these Terms and Conditions will be provided to guests free of charge.
Tenants must have a permanent place of residence and be at least 18 years of age or older.
All risks related to a stay at BECAUSE THE NIGHT ANTWERP LODGE.
are at the guests' expense.
The owner or operator is not liable for damage, loss or theft of guests' property.
In case of disputes, all (legal) costs will be borne by the guests.
Damage and loss of movable and immovable property belonging to the owner or operator must be reported (and compensated, if necessary) immediately by guests to the operator.
Guests should follow instructions from the operator.
The operator may deny guests access to BECAUSE THE NIGHT ANTWERP LODGE with immediate effect in case of violation of these General Terms and Conditions and inappropriate behaviour, without further notice and indication of reasons and without refund of accommodation fees.
The operator's records are decisive without dispute unless the guests can prove otherwise.
For all deviations not included in these conditions, the owner and/or operator will decide.
BECAUSE THE NIGHT ANTWERP LODGE must comply with these terms and conditions and the Internal Regulations.

2. Booking and Confirmation
The rental agreement can be entered into verbally, by telephone, in writing or through a request via the web form on our website or through affiliated booking sites.
You can also request availability via these website(s).Upon receipt of your reservation request, BECAUSE THE NIGHT ANTWERP LODGE will send a final confirmation by e-mail. Thereafter, the reservation is final for both parties.
The website www.becausethenight.be refers to these Terms and Conditions.
No additional reservation fee will be charged for booking a stay at Bed & Breakfast "Porta Superia".

3. Costs and Payment
The accommodation costs in Bed & Breakfast " BECAUSE THE NIGHT ANTWERP LODGE" must be paid at the latest on departure. This is preferably done via the current payment cards (Visa, Mastercard, Maestro, Payconiq), by bank transfer in advance or in cash (in Euro).
The operator may deviate from these conditions in consultation with the tenant.
When booking a period of more than 2 days, the operator may require an advance payment of 40% of the agreed rent.

For each stay, the City of Antwerp's lodging tax (or 'citytax' for short) is charged separately (current rate on website).
If it is found, even after departure, that items have been taken, stolen or damaged by guests, these costs will be charged.
These costs should be reimbursed by guests within 7 days.
In case of theft or malicious intent, it will always be reported to police.
In case of establishing the violation of the general smoking ban in our accommodation, a fine of 200 € will be charged, after repeated observations, you may be asked to leave the accommodation.
In case of loss/theft of the key, a lump sum of 150 € will be charged. If the cost exceeds this amount, a claim will be made to the guest's family insurance.

4. Cancellation or No-show
In the unlikely event that you are unable to fulfil the rental agreement entered into, you should notify us as soon as possible so that we can still offer the vacant reservation to third parties.
In case of cancellation, the tenant pays a fee to the operator according to the chosen rate:

When booking, you have the choice between flexible or non-refundable rates.
A non-refundable rate is more advantageous but has the consequence, as the name suggests, that you can no longer cancel your stay free of charge.
This is never nice news but we cannot bear this for you, we count on your understanding and respect in applying and following these conditions. However, you can move the reservation free of charge no later than 2 days before arrival and if the reservation is made directly through us and not through third-party websites.
Flexible/refundable rates can be cancelled up to 48h before your arrival.
Eg: If you booked a stay and wish to cancel less than 48h before the date of arrival, you will be charged for the entire stay.
So if you want to cancel for tomorrow, you should have cancelled by 4pm yesterday.
Even if you don't come, this stay will be charged.
if cancelled up to 2 days prior to arrival 16:00: no cancellation fee will be charged
less than 2 days before arrival or no-show: 100% of the agreed price will be charged.
The amount due is then to be transferred to the operator's bank account number or the means of payment specified at the time of booking within 14 days.
There may be derogations for longer stays and by mutual agreement with the operator.

6. Complaints and Disputes
Complaints should be reported to the operator in the first instance so that an appropriate solution can be sought immediately to make the rest of your stay as smooth as possible.
In the unlikely event that this is not satisfactory, you can send a letter to the operator (see address details above).
The Tourism Flanders Department of the Flemish Government is the competent authority that grants the licence and where further information can be obtained on the regulations governing the operation of tourist accommodation and the legal remedies generally available in case of disputes and where the tourist can lodge a complaint.

In case of disputes, only the courts of Antwerp have jurisdiction.

7. Arrival and Departure
Upon arrival, you must first report to the operator.
You will be asked to show your passport or proof of identity for purposes of legitimation.
On the day of arrival, you can use the Bed & Breakfast from 16h.
On the day of departure, the Bed & Breakfast must be vacated by 11am at the latest.
Check-in is possible during the week between 16h and 20h and on weekends between 16h and 18h30.
Check-out is possible between 7am and 11am.
The above times can be deviated from by agreement.
For later check-out or earlier check-in, a supplement of €35 or one night's stay will be charged depending on the check-in or check-out time.
There will be no refund in case of early departure.
Upon departure, the settlement will be made with you.
This includes the cost of the overnight stay any purchases and supplements and the city tax.
8. Breakfast
No breakfast facilities are provided in the house.
9. Your stay
Noise and, in particular, between 10pm and 7am is not allowed.
Radios, televisions and other sources of noise must not cause a nuisance to others. The same applies to (too loud) conversations or other activities in the rooms or common parts.
Use by third parties of the Bed & Breakfast is not allowed.
Visitors are not allowed to stay overnight in the accommodation without the operator's permission.
10. Safety and environment
The accommodation should be kept clean and tidy and left tidy.
Rubbish should be separated and disposed of in the designated bin. In the rooms, we provide a bin for residual waste, PMD and paper.
Bed linen and towels are only changed for multi-day stays at the explicit request of our guests
A first aid kit is located in each room Small fire extinguishers can be found scattered around the accommodation at the relevant signage.
The presence of suspicious persons is to be reported immediately to the operator.
Pets are not allowed ( except with the express permission of the operator an official guide dog).
Smoking and open fire are not allowed due to fire safety.
The bedrooms are suitable for sleeping up to two people with the exception of the suite which can accommodate up to four people.
The entire accommodation is suitable for sleeping up to six people (with the exception of children under 12 years old).
The accommodation is accessible 24 hours a day during your stay with the key provided at check-in.
